"Provider" or "We" refers to Theta Tontechnik/Tobias Heide. "User" or "You" refers to any individual or entity accessing or using the Service. "Commercial Use" means any use of the Service in connection with business operations, revenue-generating activities, or professional audio production work. "Personal Use" means use of the Service for individual, non-commercial, hobby, or educational purposes without any commercial benefit. SCOPE AND ADDITIONAL TERMS ================================================================================ 2.1 These service-specific Terms of Use govern your use of the Wing Routing Table Service. 2.2 In addition to these terms, the general terms of use and imprint provided at https://www.theta-tontechnik.de also apply to your use of this Service. 2.3 In the event of any conflict between these service-specific terms and the general terms, these service-specific terms shall take precedence for matters directly related to this Service. ================================================================================ 3. LICENSE GRANT AND USAGE RIGHTS ================================================================================ 3.1 Personal, Non-Commercial Use The Service is provided free of charge for Personal Use. Subject to your compliance with these terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. 3.2 Commercial Use Commercial Use of the Service requires an active paid subscription. By using the Service for Commercial Use, you acknowledge this requirement and agree to maintain an active subscription in good faith. The Provider reserves the right to request confirmation of an active subscription for Commercial Use users and to terminate access for non-compliance. ================================================================================ 4. USER-UPLOADED CONTENT AND USAGE RIGHTS ================================================================================ 4.1 For Personal, Non-Commercial Use: By uploading files or content to the Service for personal, non-commercial use, you grant the Provider a non-exclusive, perpetual, worldwide, royalty-free license to use the uploaded content for product improvement and development purposes. 4.2 For Commercial Use: Users who declare Commercial Use are EXCLUDED from the usage rights transfer described in section 4.1. The Provider will NOT use, store, or analyze content uploaded by commercial users for product improvement or development purposes beyond the immediate processing required to generate the requested output. 4.3 The license granted in section 4.1 includes, but is not limited to: a) Analyzing uploaded configurations to improve Service functionality; b) Using anonymized and aggregated data for testing and development; c) Incorporating insights from uploaded files into future product enhancements and features. 4.4 The Provider will treat your uploaded content confidentially and will not: a) Redistribute your files to third parties for commercial purposes; b) Publicly disclose your configurations without anonymization; c) Use your content in any manner inconsistent with applicable privacy laws and regulations. 4.5 You represent and warrant that you have all necessary rights to upload content to the Service and to grant the license described in this section (where applicable based on your use type). ================================================================================ 5. USER RESPONSIBILITIES ================================================================================ 5.1 You are solely responsible for: a) Verifying the accuracy, safety, and appropriateness of all routing configurations before implementing them with your equipment; b) Maintaining independent backups of all files and data you upload to the Service; c) Ensuring proper and safe use of any configurations generated by the Service; d) Any consequences, damages, or losses resulting from the use or implementation of configurations generated by the Service; e) Compliance with all applicable laws, regulations, and third-party terms in your use of the Service; f) Determining whether your use constitutes Commercial Use and complying with the subscription requirement accordingly. 5.2 You agree not to: a) Use the Service for any unlawful or prohibited purpose; b) Attempt to gain unauthorized access to the Service or related systems; c) Interfere with or disrupt the Service or servers/networks connected to the Service; d) Upload any malicious code, viruses, or harmful materials; e) Violate any applicable laws or regulations in your use of the Service. ================================================================================ 6. SNAPSHOT GENERATOR — SAFETY DISCLAIMER ================================================================================ 6.1 IMPORTANT SAFETY WARNING The Snapshot Generator creates configuration files ("snapshots") that directly control the routing, phantom power (+48V), monitor mixes, in-ear monitor (IEM) mixes, and output assignments of Behringer WING digital mixing consoles. Incorrect or unverified snapshots may cause: a) EQUIPMENT DAMAGE — Phantom power (+48V) applied to equipment that does not support it (e.g., ribbon microphones, unbalanced sources) can cause permanent, irreversible damage; b) HEARING DAMAGE — Incorrect monitor or IEM mix configurations may produce unexpected audio levels that can cause hearing injury; c) SPEAKER/AMPLIFIER DAMAGE — Incorrect output routing may send unintended signals to powered speakers or amplifiers at damaging levels. 6.2 USER OBLIGATIONS BEFORE APPLYING ANY GENERATED SNAPSHOT You MUST take ALL of the following precautions before loading any snapshot generated by this Service onto your mixing console: a) MUTE ALL OUTPUTS on the console before loading the snapshot; b) VERIFY the snapshot routing using the Service's preview/summary before loading it onto the console; c) CHECK ALL PHANTOM POWER assignments — confirm that +48V is only enabled on channels connected to condenser microphones or equipment that explicitly requires phantom power; d) CHECK ALL MONITOR AND IEM MIXES — verify that monitor and in-ear monitor bus assignments, levels, and routing are correct before unmuting; e) TEST AT LOW VOLUME — after loading the snapshot, bring up outputs gradually at low levels and verify each output individually before increasing to production levels; f) MAINTAIN A KNOWN-GOOD BACKUP SNAPSHOT on your console that you can revert to immediately if problems are detected. 6.3 GENERATED SNAPSHOTS ARE STARTING POINTS All snapshots generated by this Service are intended as starting points for your configuration work. They are NOT production-ready configurations. The Service cannot account for your specific equipment, venue, cabling, or safety requirements. You bear sole responsibility for validating and adapting any generated snapshot to your specific setup. 6.4 COMPLETE LIABILITY EXCLUSION FOR SNAPSHOT GENERATOR TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER EXPRESSLY DISCLAIMS AND EXCLUDES ALL LIABILITY FOR ANY DAMAGE, INJURY, OR LOSS ARISING FROM OR RELATED TO THE USE OF SNAPSHOTS GENERATED BY THE SNAPSHOT GENERATOR, INCLUDING BUT NOT LIMITED TO: a) Damage to microphones, speakers, amplifiers, mixing consoles, or any other audio equipment; b) Hearing damage or injury to any person; c) Damage to third-party equipment connected to your mixing console; d) Financial losses from damaged equipment, cancelled events, or interrupted productions; e) Any consequential damages arising from the application of generated snapshots. This exclusion applies regardless of whether the damage results from errors in the generated snapshot, incorrect user input, software defects, or any other cause. 6.5 ACKNOWLEDGMENT AND ACCEPTANCE OF RISK By using the Snapshot Generator, you explicitly acknowledge that you have read and understood this safety disclaimer, that you accept full responsibility for verifying any generated snapshot before applying it to your equipment, and that you will follow all precautions listed in Section 6.2. ================================================================================ 7. WINGGPT — AI ASSISTANT TERMS ================================================================================ 7.1 NATURE OF THE FEATURE WingGPT is an optional AI assistant that proposes changes to WING snapshot configurations in response to your natural-language requests. Its responses are generated by a third-party large language model (LLM) and are produced automatically. They may be inaccurate, incomplete, unsafe, or unsuitable for your equipment or situation. 7.2 ADVISORY OUTPUT — VERIFY BEFORE APPLYING WingGPT output is advisory only and is never applied to your console automatically by this Service. You remain solely responsible for reviewing and verifying every proposed change before applying it. All Snapshot Generator safety obligations in Section 6 (including muting outputs, verifying phantom power, checking monitor/IEM mixes, testing at low volume, and keeping a known-good backup) apply equally to any configuration created with the assistance of WingGPT. 7.3 ACCEPTABLE USE You agree not to: a) Attempt to manipulate, jailbreak, or bypass the assistant's instructions, guardrails, or safety constraints; b) Attempt to extract, reveal, or alter the assistant's system instructions; c) Submit prompts intended to produce unlawful, harmful, deceptive, or abusive content, or content unrelated to the legitimate use of the Service; d) Use the assistant to probe, attack, or disrupt the Service or its providers. 7.4 ABUSE MONITORING, STRIKES, AND SUSPENSION To protect the Service and its users, the Provider may review messages submitted to WingGPT, by automated means and/or manually, to detect abuse and violations of these terms. Violations may be recorded as "strikes" against your account. Reaching a configured strike limit will result in suspension of your access to WingGPT. The Provider may, at its discretion, adjust limits, dismiss strikes (for example, to correct false positives), and reinstate access. 7.5 DATA HANDLING FOR WINGGPT When you use WingGPT, the content of your messages together with relevant snapshot context is transmitted to a third-party LLM provider in order to generate a response. The Provider may store your messages and the associated context for the purposes of operating, securing, and improving the Service and enforcing these terms, including the abuse monitoring described in Section 7.4. Do not submit confidential information or personal data that you do not wish to be processed in this manner. The Provider's handling of personal data is further described in its privacy policy. 7.6 NO PROFESSIONAL ADVICE WingGPT does not provide professional audio-engineering advice. The Professional Advice Disclaimer in Section 11 applies fully to WingGPT. 7.7 AVAILABILITY AND LIMITS WingGPT may be modified, rate-limited, suspended, or discontinued at any time as described in Section 12 (Data Handling and Service Availability). Availability and usage limits may depend on your subscription tier. ================================================================================ 8. DISCLAIMER OF WARRANTIES ================================================================================ 8.1 THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. 8.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: a) Implied warranties of merchantability, fitness for a particular purpose, and non-infringement; b) Warranties regarding the accuracy, reliability, or completeness of the Service or any content generated by the Service; c) Warranties that the Service will be uninterrupted, timely, secure, or error-free; d) Warranties that any errors or defects in the Service will be corrected. 8.3 You acknowledge and agree that: a) The Service is a tool for generating routing configurations and that you bear sole responsibility for verifying the accuracy and safety of any configurations before implementation; b) The quality and performance of the Service may not meet your specific expectations or requirements; c) Use of the Service is at your own risk. ================================================================================ 9. LIMITATION OF LIABILITY ================================================================================ 9.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PROVIDER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. 9.2 This limitation of liability includes, but is not limited to, damages for: a) Loss of profits, revenue, data, use, goodwill, or other intangible losses; b) Damage to audio equipment, hardware, or other physical property; c) Costs of procurement of substitute goods or services; d) Business interruption or downtime; e) Any other damages or losses arising from your use, inability to use, or reliance on the Service or any content generated by the Service. 9.3 This limitation applies regardless of the legal theory on which the claim is based (contract, tort, negligence, strict liability, or otherwise) and even if the Provider has been advised of the possibility of such damages. 9.4 Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, the Provider's liability shall be limited to the maximum extent permitted by law. ================================================================================ 10. PROFESSIONAL ADVICE DISCLAIMER ================================================================================ 11.1 The Service is a technical tool designed to assist with routing configuration tasks. It does not constitute, and should not be construed as, professional audio engineering advice, consulting services, or professional recommendations. 11.2 You should consult with qualified audio engineering professionals before implementing any configurations generated by the Service, particularly in: a) Professional or commercial audio production environments; b) Critical audio systems where failure could result in significant consequences; c) Live performance or broadcast situations; d) Any situation where equipment damage or audio quality issues could result in financial loss or safety concerns. 11.3 The Provider makes no representations regarding the suitability of any configurations for any particular purpose or application. ================================================================================ 12. DATA HANDLING AND SERVICE AVAILABILITY ================================================================================ 12.1 Service Availability a) The Provider makes no guarantee regarding the continuous availability, uptime, or accessibility of the Service; b) The Provider reserves the right to modify, suspend, or discontinue the Service (in whole or in part) at any time with or without notice; c) The Provider shall not be liable for any modification, suspension, or discontinuation of the Service. 12.2 Data Retention and Backup a) The Provider makes no guarantee regarding the retention, backup, or recoverability of any uploaded files or generated configurations; b) You are solely responsible for maintaining your own backups of all files, data, and configurations; c) The Provider shall not be liable for any loss, corruption, or deletion of data. 12.3 You acknowledge and accept the risks associated with online services, including but not limited to data loss, service interruptions, and security vulnerabilities. ================================================================================ 13. TERMINATION ================================================================================ 13.1 These terms remain in effect until terminated by either you or the Provider. 13.2 You may terminate your use of the Service at any time by ceasing to access or use the Service. 13.3 The Provider may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to: a) Breach of these Terms of Use; b) Misuse or abuse of the Service; c) Non-compliance with the Commercial Use subscription requirement; d) At the Provider's sole discretion. 13.4 Upon termination, your right to use the Service immediately ceases. Sections 4, 5, 6, 7, 8, 9, 10, 11, 12.2, 14, and 15 shall survive any termination of these terms. ================================================================================ 14. The remaining provisions shall continue in full force and effect. 15.3 Waiver No waiver of any term or condition of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition. The Provider's failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision. 15.4 Assignment You may not assign or transfer these terms or your rights hereunder without the Provider's prior written consent. The Provider may assign or transfer these terms without restriction. Any attempted assignment in violation of this section shall be null and void. 15.5 Amendments The Provider reserves the right to modify or amend these Terms of Use at any time. Updated terms will be posted with a new "Last Updated" date. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes. 15.6 Language These Terms of Use are provided in English.
